Kritikal Hit — Privacy Policy

This Privacy Policy describes how Kritikal Hit LLC, a Colorado limited liability company ("Kritikal Hit," "we," "us," or "our"), collects, uses, and shares information when you use the website located at kritikalhit.com and the software, tools, content, and services offered through it (collectively, the "Services"). This Policy is incorporated into and forms part of our Terms of Service. By using the Services, you agree to the practices described here.

The short version: we collect what we need to run a DFS analytics subscription — your account details, your saved work, payment records, and standard technical logs. We use your saved work to power your experience, and we use it in aggregated, de-identified form to make the tools sharper for everyone. We do not sell your personal information, we do not share it for targeted advertising, and no individual subscriber's private lineups or projections are ever reviewed to inform anyone's personal contest play.

1. Information We Collect

Account information. When you register, we collect your email address, a display name, and a password (stored only in hashed form — we cannot see it). If you contact support, we collect the contents of that correspondence.

Payment information. Payments are processed by our third-party payment processor (currently Stripe). We do not collect or store full payment card numbers. We receive from the processor limited transaction records — such as your subscription plan, transaction amounts and dates, billing status, and partial card information (for example, card brand and last four digits) — needed to manage your subscription.

Content you provide ("Your Content"). The Services let you enter, upload, edit, and save your working materials: player projections and projection edits, lineups, exposure and quota settings, templates, locks, and similar inputs and configurations. We store this so the Services can function — it is your workspace.

Usage and log data. When you use the Services, we automatically collect standard technical information: IP address, browser type and version, device information, pages viewed, features used, timestamps, and server logs (including security logs).

Cookies and similar technologies. We use cookies and similar technologies that are essential or functional: keeping you signed in, remembering your settings, securing sessions, and protecting the Services from abuse (including cookies set by our infrastructure and security providers, such as our content delivery network). We do not use third-party advertising cookies, and we do not permit third parties to track you across other websites through the Services. If we add analytics tools in the future, we will update this Policy first. Because we do not track you across third-party sites, the Services do not respond to browser "Do Not Track" signals, which have no standardized meaning.

2. How We Use Information

We use the information described above to:

  • provide, operate, maintain, and secure the Services, including saving and rendering Your Content back to you;
  • process subscriptions and payments, manage billing, and prevent fraud and abuse;
  • provide customer support and respond to your requests;
  • send transactional communications (such as receipts, security notices, and material changes to the Services or our terms), which are a necessary part of the Services;
  • send occasional product news or marketing communications, which you can opt out of at any time via the unsubscribe link or by contacting [email protected] — transactional messages continue regardless because the Services require them;
  • improve and develop the Services using aggregated and/or de-identified data as described in Section 3; and
  • comply with legal obligations and enforce our Terms of Service.

3. Aggregated and De-Identified Data

As described in Section 7.3 of our Terms of Service, we use Your Content and usage data in de-identified and/or aggregated form — combined with data from other users and/or stripped of identifiers such that neither you nor your account can reasonably be identified — to develop, train, calibrate, test, and improve the Services and our underlying models and analytics. Concretely, this is how subscriber activity makes the product better for every subscriber: sharper ownership projections, better-calibrated badges and indicators, and more accurate simulation and optimization models. We may also create and publish aggregate statistics and insights (for example, trends across the subscriber base as a whole). Aggregated and de-identified data is not personal information, and we may retain and use it indefinitely, including after you close your account.

Our individual-data commitment. Kritikal Hit personnel do not access or review any individual subscriber's private, non-public lineups, projections, or configurations for the purpose of informing any personnel's own contest entries, and no Kritikal Hit personnel's personal contest play makes use of subscriber data except in the aggregated, de-identified forms described above that are reflected in features available to subscribers generally. Access reasonably necessary for customer support (including support you request), security, fraud prevention, service operation and maintenance, or legal compliance is not restricted by this commitment.

4. How We Share Information

We do not sell your personal information, and we do not share it with third parties for targeted advertising. We share information only as follows:

  • Service providers. We use third-party providers to operate the Services — for example, payment processing (Stripe), cloud hosting, content delivery and security, and email delivery. These providers may access personal information only to perform services for us and are obligated not to use it for other purposes.
  • Legal requirements. We may disclose information if required by law or legal process, or when we believe in good faith that disclosure is necessary to comply with a legal obligation, protect the rights, property, or safety of Kritikal Hit, our users, or the public, enforce our Terms of Service, or detect and prevent fraud or security issues.
  • Business transfers. If Kritikal Hit is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to this Policy's commitments.
  • With your consent. We may share information for other purposes if you direct us to or give consent.

5. Data Retention

We retain your account information and Your Content while your account is active. Some plan tiers include defined retention windows for historical workspace data (such as past slates and saved run history), as described in the product; content outside your plan's retention window may be summarized and trimmed. If you close your account, we delete or de-identify personal information within a reasonable period, except where retention is required for legal compliance, dispute resolution, security, fraud prevention, or enforcement of our agreements (for example, billing records are retained as required by tax and accounting law). Aggregated and de-identified data may be retained indefinitely as described in Section 3.

6. Security

We use technical and organizational measures designed to protect your information, including encryption in transit (TLS), hashed password storage, access controls, network security protections, and hardened infrastructure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; please use a strong, unique password and notify us immediately at [email protected] of any suspected unauthorized access to your account.

7. Your Choices and Rights

Access, correction, and deletion. You can access and update much of your information directly in your account settings. You may also contact us at [email protected] to request access to, correction of, deletion of, or a portable copy of your personal information. We honor these requests for all users, subject to verification of your identity and to exceptions permitted by law (for example, records we must retain for billing compliance).

Marketing opt-out. You can opt out of marketing emails at any time using the unsubscribe link in any marketing message or by contacting [email protected]. Transactional emails (receipts, security notices, terms changes) are part of the Services and continue while you have an account.

State privacy rights. Depending on where you live, state law (such as the Colorado Privacy Act or the California Consumer Privacy Act) may grant you specific rights regarding your personal information, including rights to access, correct, delete, or obtain a copy of it, and to opt out of the sale of personal information, sharing for targeted advertising, or certain profiling. We do not sell personal information or share it for targeted advertising, and we do not engage in profiling that produces legal or similarly significant effects. To exercise any right, contact [email protected]; if we decline a request, you may appeal by replying to our decision, and we will respond as required by applicable law. We will not discriminate against you for exercising your rights.

Users in Canada. If you are in Canada, we collect, use, and disclose personal information as described in this Policy with your consent or as otherwise permitted by law, and you have rights to access and correct your personal information by contacting us as described above.

8. Children

The Services are not directed to anyone under eighteen (18), and we do not knowingly collect personal information from anyone under 18. If you believe someone under 18 has provided us personal information, contact us at [email protected] and we will delete it.

9. Where Information Is Processed

Kritikal Hit is based in the United States, and information is processed and stored in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those of your jurisdiction.

10. Changes to This Policy

We may update this Privacy Policy from time to time. If we make a material change, we will provide advance notice (for example, by email or in-product notice) before it takes effect and update the "Last updated" date above, and we may ask you to re-accept it. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
